By accessing or using Shiftctl ("Service") you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
These Terms are governed by the laws of Australia. Users in the UK and EU may have additional statutory rights that are not affected by these Terms.
Shiftctl is a cloud-based on-call shift management platform that enables IT and MSP teams to log shift activity, manage handoffs, and coordinate on-call schedules. We reserve the right to modify or discontinue features with reasonable notice.

You retain ownership of all data you input into Shiftctl ("Customer Data"). You grant us a limited licence to store and process Customer Data solely to provide the Service. We will not access Customer Data except to provide support, ensure security, or as required by law.

The Service, including its software, design, and content, is owned by Shiftctl and protected by copyright and other intellectual property laws. These Terms do not grant you any ownership rights in the Service.
We aim for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind to the maximum extent permitted by law. Nothing in these Terms excludes statutory rights you may have under Australian Consumer Law, the UK Consumer Rights Act, or equivalent legislation.
To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
We may suspend or terminate your account if you breach these Terms. You may delete your account at any time from Settings. On termination, your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of Victoria, Australia. Disputes shall be resolved through good-faith negotiation. If unresolved, either party may pursue remedies through the courts of Victoria, without prejudice to any statutory dispute resolution rights available to consumers in the UK or EU.
We may update these Terms with 14 days' notice via email or in-app notification. Continued use after the notice period constitutes acceptance of the updated Terms.
